Conditions of participation for the DURAL web competition

These conditions of participation govern participation in the competition “Mix.Match.Win. Colour Your Style” competition in the period from 13.09.2024 to 31.10.2024 of DURAL GmbH, Südring 11, 56412 Ruppach-Goldhausen (hereinafter referred to as the organizer). Participation in the competition “Mix.Match.Win. Color Your Style” competition is free of charge and is governed exclusively by these terms and conditions of participation.

Participants

Only companies or their representatives are eligible to participate. All employees of the organizer, their relatives or employees of cooperation partners who are involved in the competition are excluded from participation. Participation in the competition does not oblige the participant to purchase goods or services from the organizer. The participant agrees to being contacted by the organizer for information purposes.

Procedure of the competition

The competition will take place in the period from 13.09.2024 to 31.10.2024. Participation in the competition is free of charge, regardless of whether the participant is a customer of the organizer.

The following prizes will be raffled off to an individual:

1 x Apple iPad (10.9″, Wi-Fi, 64 GB) – Silver (10th generation or newer)

Participants can enter the competition on the DURAL website https://de.dural.com/colour-your-style. To enter the competition online, participants must enter their first and last name, company, address, country, telephone number and e-mail address. The online entry form can be completed and submitted until the end of the competition period. Correctly completed online entry forms sent by confirmation email are eligible to participate.

Participation

You do not need to register to take part in the competition. All you need to do is complete the contact details on the entry media and submit the online entry form.

Participation by other means is not intended. If the contact details provided are incorrect (incorrect e-mail address, company details), the organizer is not obliged to search for the correct address. Any disadvantages arising from the provision of incorrect contact details shall be borne by the participant.

Each participant may only enter once by providing their contact details. The closing date for entries is the last day of the event period. The time stamp when submitting the online entry form serves to check that the entry deadline has been met. Participation via competition agencies is prohibited, as is multiple participation by one participant with several e-mail addresses in order to increase the chances of winning.

The organizer is entitled to exclude individual persons from participation, e.g. in the event of violations of the aforementioned conditions, false or misleading information in connection with participation in the competition or in the event of a demonstrable attempt to manipulate or manipulation that has taken place.

Warranty

The organizer cannot guarantee the availability of the competition online. The competition may be terminated due to external circumstances without the participant being able to derive any claims from this.

Determining the winners

The individual winners will be determined in a random draw in the week following the end of the competition. If the participant forgoes the prize, the next participant in the draw will receive the prize. The prize winner will be drawn from all participants who have taken part.

The participant drawn will be notified by e-mail immediately after the draw and asked in the e-mail to confirm that they accept the prize. If the participant does not confirm that they accept the prize within 7 days of receiving the notification, the next participant after them will be the winner.

The prize will only be handed over to the winner. An exchange or cash payment of the prize is not possible. Prizes in kind will be sent to the winner by post to their home address; the organizer will bear the shipping costs for this. The winner is responsible for paying any taxes on the prize.

It is not possible to pay out a prize in cash or exchange the prize, and the prize cannot be transferred to third parties.

Termination of the competition

The organizer expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to amend these conditions of participation.

Liability and legal action

The organizer is not liable for damages caused by errors, delays or interruptions in transmission, malfunctions of the technical equipment and service, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition, unless such damages have been caused intentionally or through gross negligence by the organizer (its bodies, employees or vicarious agents). The above limitation of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects.

The competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is excluded.

Data protection information

Participation in the competition requires the provision of personal data. The participant assures that the personal details provided by him/her, in particular first name, surname and address, are true and correct.

The participant’s contact details such as first name, surname, email address and address will be collected, processed and used to carry out the competition in accordance with the legal requirements. The data of the participants in the competition will be stored for 6 months after the competition has been held in order to be able to check possible claims by the participant and then deleted.

The collection and processing of personal data is used exclusively to carry out the competition, to determine the winners, to send the prize and to contact the organizer by e-mail or telephone. Participants’ personal data will not be passed on to third parties or made available to them for use without their consent.

The participant may at any time obtain information about his/her data stored by the organizer, object to the use of his/her data and request its deletion. A simple letter to DURAL GmbH, Südring 11, 56412 Ruppach-Goldhausen or an e-mail to info@dural.de is sufficient for this purpose. After revocation of consent, the participant’s personal data collected and stored will be deleted immediately.

Severability clause

Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision.

The same applies in the event of a loophole in these conditions of participation.
